ag3ntHUB Terms of Service

Welcome to ag3ntHUB. By accessing or using the ag3ntHUB website and services (the "Service") at ag3nthub.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

ag3ntHUB is an Instagram Content Planner & Scheduler for Real Estate Professionals, providing tools to organize, prepare, review, schedule, and publish content to the user's own connected Instagram Professional account.

These Terms constitute a legally binding agreement between you and ag3ntHUB. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

You must be at least 18 years of age and legally able to enter into a binding agreement to use the Service. By registering an account, you represent and warrant that you meet these eligibility requirements.

ag3ntHUB is designed for real estate professionals. Users are responsible for ensuring they hold any required licenses, certifications, or authorizations applicable to their professional activities in their jurisdiction.

To use the Service, you must register an account by providing accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information and for keeping your password and account credentials confidential.

You may not transfer or assign your account to another person. You are responsible for all activities that occur under your account and must notify ag3ntHUB immediately of any unauthorized use or security breach.

You are responsible for safeguarding your account credentials and for all activities conducted under your account. ag3ntHUB is not liable for any losses or damages resulting from unauthorized account access.

You agree to use strong passwords, enable available security features, and not share your login credentials with third parties. If you suspect unauthorized access to your account, you must change your password and contact ag3ntHUB through the in-app support interface immediately.

ag3ntHUB is a professional productivity tool intended for licensed real estate professionals and related industry users. Users are solely responsible for ensuring that their use of the Service complies with all applicable real estate regulations, fair housing laws, and professional conduct requirements.

Users must not use the Service in any manner that could constitute a violation of real estate licensing laws, fair housing regulations, or consumer protection requirements in their jurisdiction.

"User Content" refers to any content you upload, create, select, or publish through the Service, including property listings, photos, media files, captions, text, and scheduled posts.

You retain ownership of your User Content. By using the Service, you grant ag3ntHUB a limited license to host, store, process, and transmit your User Content solely as necessary to provide the Service, including publishing content to your connected Instagram account according to your configured settings.

You are solely responsible for your User Content and for ensuring it complies with all applicable laws, regulations, and third-party platform requirements.

ag3ntHUB allows users to input, import, and manage property listing information for the purpose of preparing and scheduling Instagram content. Property data may include addresses, prices, descriptions, photos, and related details.

Users represent and warrant that they have the right to use, display, and publish all property listing content through the Service, including any photos, descriptions, or data obtained from MLS systems, third parties, or other sources. Users must comply with all MLS rules, copyright laws, and data licensing agreements applicable to their listing content.

ag3ntHUB allows users to connect their own Instagram Professional account to the Service. The Instagram integration enables users to:

• Connect their Instagram Professional account via official Instagram API authorization
• Prepare and organize content for Instagram publication
• Select media and photos for publishing
• Schedule posts for automatic or manual publication
• Publish content to their own Instagram account
• Manage and review the status of scheduled and published posts

The Instagram integration is provided as a content planning and scheduling tool. ag3ntHUB does not create advertising campaigns, manage paid promotions, or provide advertising management functionality through the Instagram integration.

Users must maintain a valid Instagram Professional (Business or Creator) account and grant the necessary permissions for publishing. ag3ntHUB only performs Instagram actions that are authorized or configured by the authenticated user.

The ag3ntHUB Content Planner is a calendar-style interface that allows users to organize their upcoming Instagram content. The planner displays scheduled posts with details including:

• Post thumbnail or preview image
• Associated property or listing
• Scheduled date and time
• Content type (e.g., single image, carousel)
• Publishing status (Draft, Scheduled, Published, Failed)

The planner is an organizational and publishing tool. It is not an Instagram advertising management platform. Users can review, edit, approve, or cancel scheduled content before publication.

ag3ntHUB provides server-side scheduled publishing, allowing users to schedule content for automatic publication at a selected date and time. When a user schedules content, ag3ntHUB may automatically execute the publishing action without requiring the user to keep their browser open or maintain an active session.

Scheduled publishing only occurs for:

• The authenticated user's connected Instagram account
• Content belonging to that user
• A schedule configured or authorized by that user

ag3ntHUB never allows one user's scheduled content to publish to another user's Instagram account. Each publishing action is tied to the user's own authorized Instagram connection.

While ag3ntHUB attempts to publish scheduled content at the configured time, publication may occasionally be delayed or fail due to circumstances including Instagram API availability, Meta platform restrictions, expired authorization, account permission changes, connectivity issues, or invalid/unsupported media. The application displays publishing status so users can understand when a scheduled post has failed.

The Service integrates with third-party platforms such as Meta and Instagram. Use of third-party services is subject to their respective terms of service, privacy policies, and platform policies.

ag3ntHUB is not responsible for the practices or policies of third-party services. Users are responsible for complying with the terms and policies of any third-party platform they connect to through the Service.

ag3ntHUB is not sponsored by, owned by, endorsed by, or operated by Meta or Instagram. Meta and Instagram are trademarks of their respective owners.

Users are responsible for their use of the Service and all content they publish. Specifically, users must:

• Ensure their content complies with all applicable laws and regulations
• Comply with real estate regulations and fair housing requirements
• Respect copyright and intellectual property rights
• Follow applicable advertising and disclosure requirements
• Comply with Instagram and Meta platform policies and community guidelines
• Ensure their content is accurate and not misleading
• Maintain valid authorization for all media and data they publish

Users remain solely responsible for the content they choose to prepare, schedule, and publish through the Service.

The ag3ntHUB Service, including its design, features, branding, software, and content (excluding User Content), is the property of ag3ntHUB and is protected by intellectual property laws. Users may not copy, modify, distribute, or create derivative works from the Service without prior written permission.

Users retain all intellectual property rights in their User Content. ag3ntHUB does not claim ownership of User Content and only uses it as necessary to provide the Service.

Users must not:

• Use the Service for any unlawful purpose or in violation of any law
• Publish content that violates fair housing laws or real estate regulations
• Upload or publish content that infringes on others' intellectual property rights
• Attempt to access another user's data or account
• Use the Service to send spam, unsolicited content, or misleading advertisements
• Attempt to disrupt, overload, or compromise the Service's infrastructure
• Use the Service to publish content that violates Instagram/Meta policies
• Reverse engineer, decompile, or otherwise attempt to extract source code
• Use the Service in any manner that could damage, disable, or impair the Service

ag3ntHUB strives to maintain high availability but does not guarantee that the Service will be uninterrupted, error-free, or available at all times. The Service may be temporarily unavailable due to maintenance, updates, infrastructure issues, or circumstances beyond our control.

Scheduled publishing and Instagram integration functionality depend on the availability of third-party APIs (including the Instagram Graph API) and may be affected by external factors. ag3ntHUB is not liable for failures or delays caused by third-party services.

ag3ntHUB may suspend or terminate your account and access to the Service if you violate these Terms, engage in prohibited activities, or if ag3ntHUB reasonably believes you have acted unlawfully or in a manner that could harm the Service or other users.

You may terminate your account at any time through the in-app account deletion feature in Settings. Upon termination, your right to use the Service ceases, and your data will be handled in accordance with our Privacy Policy.

ag3ntHUB reserves the right to modify or discontinue the Service, or any part of it, with or without notice. ag3ntHUB is not liable to users or any third party for any modification, suspension, or discontinuance of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. ag3ntHUB does not warrant that the Service will be error-free, uninterrupted, secure, or that scheduled content will always be successfully published.

Instagram publishing depends on third-party API availability, account permissions, and platform restrictions that are outside ag3ntHUB's control. ag3ntHUB does not guarantee that scheduled posts will be published at the exact time selected or that publishing will always succeed.

ag3ntHUB is not responsible for the accuracy, legality, or appropriateness of User Content. Users are solely responsible for the content they publish.

To the fullest extent permitted by applicable law, ag3ntHUB and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising from or related to your use of the Service.

ag3ntHUB's total liability for any claim arising from or related to the Service shall not exceed the amount you have paid to ag3ntHUB for the Service in the twelve (12) months preceding the claim, or if you have not paid any fees, then ag3ntHUB's liability shall be limited to the maximum extent permitted by applicable law.

ag3ntHUB may modify these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. We encourage users to review these Terms periodically.

If material changes are made, we will provide notice through the Service or by other reasonable means. Continued use of the Service after any such changes constitutes acceptance of the updated Terms.
